1. Discussion of Agenda Items
2. Ken Hardin- Renovation 288 Resaca Beach Blvd. NW
Mr. Hardin presented the mayor and council with plans for a remodel and refurbishment of the Flying J and to change name to Pilot. Councilman Randy Keese asked if there are any plans regarding safety issues. Mr. Hardin answered that the specific renovation does not address safety with traffic, but he can look into the possibility. There are no structural changes in the plans. One addition is behind the building for a small storage building and a fence around the dumpster closure to make it aesthetically pleasing. Councilwoman Sandy Adams asked about the outside lighting. Mr. Hardin confirmed that the entire site lighting will be redone. Councilwoman Rene Keese asked if the store would close for remodel, Mr. Hardin answered it will not close. It may take around 150 days to complete. Mayor Wyatt commented on the lack of interstate lighting and asked about interstate lighting for the store. Mr. Hardin stated that it cannot be off the property, but he can consider lighting that would face the exit next to the property. Councilman Keese asked Mr. Hardin if he can commit to having 2 lights installed at the property facing the exit ramp. Mr. Hardin stated that he can commit to that. Mayor Wyatt asked if he can also address the company about public safety issues associated with the property. Attorney Bentley confirmed that Mr. Hardin would not have a problem with the lighting provision being added as part of the motion when the council votes at the regular meeting. Mr. Hardin confirmed he can make that commitment.
3. Trent Frix- Monkeys Loop
Mr. Frix addressed the council needing an approval letter for a general construction permit. Councilman Randy Keese answered, no and that he and the council have major problems with Monkeys Loop and that Mr. Frix was supposed to tear down the existing trailers to move in travel trailers for nurses. Mr. Frix stated that his plans were to tear down some of the trailers. Councilman Randy Keese stated that it has been more than 2 years and there has been no action. Mr. Frix stated that he gave the residents a year to move before starting work at the beginning of this year, having already removed 20 dumpster loads of trash and spent approximately 100,000.00 dollars between trash removal and having sewer run on bottom line. He stated that he did not say he planned to tear down all the trailers, but that he was planning to leave half of them and move in 10 RV’s to the lot and bring in new mobile homes for the other half. Councilman Randy Keese stated that the Special Use Permit that was issued is only good for 12 months and if the project has not been completed within 12 months it can be voted to rescind the Special Use Permit. Attorney Bentley advised Mr. Frix to have plans prepared for the council to vote on that particular request because the existing condition of the homes and he needed to move forward with the clean-up before coming back to the council for approval to meet requirements of the zoning and he did not need a permit to start cleaning up the property.

Since that has not been done within the one-year time period he will bring up for a vote to rescind the special use permit for the property.

Councilman Randy Keese told her that each situation could be addressed according to the importance. Jim Perkins, the owner of Twelve Oaks Pond, addressed the council about the noise complaint. He stated that there is a verbal agreement between him and Mayor Wyatt to keep the volume to 100-decibels. It is not a part of the Special Use Permit. There is a sound monitor that he checks regularly, and he does not know where the music was from because there was no event at the venue in the past 3 weeks.
Trent Frix spoke to the council regarding the denial of his letter of approval to gain a permit from Gordon County. Attorney Bentley told Mr. Frix he will not be able to have approval until he files a request to renew his plans due to the year of expiration. Mr. Frix asked for clarification that the ability to have a permit to move new mobile homes in and renovate mobile homes is a Special Use Permit. Attorney Bentley stated that it is his understanding that is the way it was approved. Councilman Randy Keese stated that the Special Use Permit was for removing the mobile homes and having new travel trailers set up and the tear down on the old homes. Mr. Frix stated that is not true. Mr. Frix wanted to keep the mobile home park and move in RV’s. Councilmember Randy Keese states the mobile homes are uninhabitable. Mr. Frix asked for a denial in writing. The minutes will reflect the denial that was made based upon Gordon County requesting Resaca’s approval before issuing building permits, the condition of the mobile homes and the Special Use Permit that was issued and not followed upon. Mr. Frix stated again that the Special Use Permit was issued for 10 RV slots. Councilmember Randy Keese answered that he needed a building permit and he did not obtain one before working on the mobile homes. Councilmember Randy Keese and Attorney Bentley both stated that a code enforcement letter will be sent to Mr. Frix. He will be able to do certain clean-up and haul-off without a permit per Mr. Bentley. Mr. Frix stated he was already in the process of cleaning up and has spent approximately 25,000 on trash removal, that there is a significant difference in the property than there was a year ago. Mr. Frix stated the council voted on the wrong thing and asked that the denial state he was denied on the Special Use Permit. Councilmember Randy Keese answered that is was not the reason for denial of approval for building permits, it is the condition of mobile homes. Attorney Bentley stated that it was only brought to his attention that he had a year to act upon his Special Use Permit and that it is in the ordinance. Mr. Frix answered that he was not aware of that and he only has a letter for approval of the Special Use Permit. Councilmember Randy Keese said that once the tear down starts that Mr. Frix will need to approach the council again. Attorney Bentley stated he does not need a permit to start the haul off process.
