CALL TO ORDER
Mayor Wyatt welcomed everyone to the Public Hearing.
PUBLIC HEARING
Mayor Wyatt opened the Public Hearing for Kenneth Franklin. Mr. Franklin has

submitted an application for annexation into the city of Resaca and rezone from A-
1 to R-1. His address is 126 Upper Tate Bend Rd. NW.

Donna Sparks @ 148 Upper Tate Bend is opposed to the annexation with concerns
about the number of chickens on Mr. Franklins property. She spoke of multiple
ordinance violations in the past and Resaca did not have an ordinance against the
chickens if future violation occurs.
Pam Coker @ 1583 Nickelsville Rd. has concerns about Mr. Franklin’s rights to
the property. A copy of the will was read explaining that he does have legal rights.
Kathy Lanier @ Upper Tate Bend is opposed, expressing concern for too many
chickens that smell and attract rats or snakes.
Tina Clements @ 190 Upper Tate Bend Rd. is opposed, expressing the same
concerns as previous speakers. Also, adding that the property is not big enough for

the number of chickens. She is afraid it will lower her property value.
Taylor Spangler @ 158 Upper Tate Bend Rd. is opposed, expressing concerns with
her home value, the # of chickens and their living condition, the debris/cars on the
property and vermin.
Lisa Hagan @ 138 Upper Tate Bend Rd. stated that she is the sister of Mr.
Franklin, and she is also opposed.
Mayor Wyatt asked Kenneth Franklin to come forward and speak in rebuttal.
Kenneth Franklin stated that there are chickens on the property in separate pens.
He stated that the rats are not coming from his property. They are from land being
cleared with low ground impact cutting and bushhogging just south of the area.
There are two vehicles that are on the property, one is a personal vehicle, with
transmissions to be swapped and then one will be removed. There is a work
vehicle. There are approximately eighteen game chickens that are leaving the
property. There are nine small banty chickens that he will keep. When asked by
Council, Kenneth states that he will be willing to abide by any ordinance or
regulations imposed by the city of Resaca. The council will vote during the regular
meeting at 7:00 PM.
